The Nova Scotia Barristers Society decided not to appeal their loss in the TWU case to the Supreme Court of Canada. This is a mixed blessing. On the one hand, it would have been great to see this case taken to the SCC from Nova Scotia. However, the Ontario Court of Appeal decision is being appealed. We are still waiting for the decision of the BC Court of Appeal.

    Question: Does the fact that the Nova Scotia Bar is not going to appeal – mean that the Judge’s Reasons for Decision against them, which, by the way were logical and fair-minded, cannot be used in the upcoming Supreme Court case? Just wondering.

      Hi Trudy, no – we will be able to use the decisions of the Nova Scotia courts when we make arguments at the Supreme Court of Canada. This is a good thing for sure. However, whatever the Supreme Court of Canada decides will affect across the country.
