Did you know that CCCC has intervened in court and tribunal cases since 1993? And that we've intervened at the Supreme Court of Canada half a dozen times? This is part three in our “Did You Know” series about CCCC interventions, a significant and important part of our advocacy work. Missed parts one and two? Read our March and April Bulletins to find out what intervention is all about.
This month we'll answer: in what kind of cases has CCCC intervened?
CCCC has intervened in a variety of court cases to address different aspects of the law, whether charity law, human rights law, or constitutional freedoms. For example, in the Aga case at the Supreme Court of Canada, the issue was church membership. CCCC intervened to clarify that a donation or tithe does not create a legally binding contract between the donor and the charity. By definition, a gift is given freely, with no expectation of anything in return.
In another membership-related case, Wall, CCCC argued that religious groups should have the freedom to make their own membership decisions on spiritual matters, without interference from the court. Religious freedom was also a central issue in the Trinity Western cases, which focused on whether a Christian university could establish a law school based on its biblically-informed community values.
CCCC consistently intervenes in court cases to protect the rights of faith-based organizations. For instance, CCCC has argued that these organizations should be able to apply religious requirements when hiring staff, that religious schools should be able to teach their faith from a religious perspective rather than a secular one, and that religious groups should have equal access to publicly available rental facilities.
