Supreme Court of Canada

CCCC Interventions - Did You Know?

Did you know that CCCC has intervened in court and tribunal cases since 1993? And that we've intervened at the Supreme Court of Canada half a dozen times? Over the next few editions, we're going to answer a few questions about this important part of our advocacy work.

Let's start with the basics: what is an intervention?

An intervention allows someone who is not directly involved in a court case to share their perspective with the court. This third party, called an "intervener," can present arguments or information that might help the court understand the issue from a different point of view.

However, an intervention isn't about supporting one of the parties involved in the case. Instead, the intervener offers their own views about a legal issue. Interveners don’t argue for a specific outcome, introduce new issues, or change the scope of the case. They must be careful to provide relevant information that adds value, without simply repeating what the parties have already argued.

Ultimately, whether or not an intervener is allowed to participate is up to the court. The court can choose to accept some, all, or none of the requests for intervention in any given case.
