UPDATE<\/strong> (October 23, 2025)<\/p>\n\n\n\n

In early October the federal government introduced Bill C-12, Strengthening Canada\u2019s Immigration System and Borders Act<\/a>.<\/em>\u00a0 Bill C-12 extracts certain parts<\/a> of Bill C-2 to fast track them through the Parliamentary process. Taking this approach gives \u201cadditional time to evaluate the other measures<\/a>\u201d in C-2; in other words, some of the more controversial and criticized elements of C-2.<\/p>\n\n\n\n

One of those \u201cother measures\u201d is the prohibition on cash donations of $10,000 or more, whether in a single gift or a \u201cprescribed series of gifts\u201d.<\/p>\n\n\n\n

This is good news for the charitable sector as it gives more time for the government to reconsider the necessity of the prohibition in light of existing compliance tools.<\/p>\n\n\n\n

We are still awaiting a response from the Finance Minister to our June letter and will keep you updated on any response we receive.<\/p>\n\n\n\n

The government recently introduced Bill C-2, Strong Borders Act. Commentators and news outlets have raised concerns about its potential impact \u2013 from refugees<\/a> to privacy<\/a> to cash donations<\/a> to charity. Here we\u2019ll take a closer look at the proposed change to cash donations.<\/p>\n\n\n\n

What is Bill C-2?
<\/strong>First, some context is important. Bill C-2<\/a> is an \u201comnibus bill.\u201d An omnibus bill is a government bill that proposes to \u201crepeal, amend or enact more than one Act<\/a>\u201d without any comment element. In other words, it\u2019s a mish-mash of changes to a wide variety of laws. That can make it challenging to effectively respond to the bill as a whole because some parts might be good, while other parts might be bad.<\/p>\n\n\n\n

What is proposed?
<\/strong>There is a lot to review in the 140 pages that make up Bill C-2, but the proposal to prohibit cash donations of $10,000 has already raised some questions for the charitable sector.<\/p>\n\n\n\n

Part 11 of the Bill would add a new section to the Proceeds of Crime (Money Laundering) and Terrorist Financing Act (Cash Transactions)<\/a><\/em>:<\/p>\n\n\n\n

77.\u200d5\u2002(1)\u2002Every person or entity that is engaged in a business, a profession or the solicitation of charitable<\/strong> financial donations<\/strong> from the public commits an offence if the person or entity accepts a cash payment, donation or deposit of $10,000 or more in a single transaction or in a prescribed series of related transactions that total $10,000 or more.<\/p>\n<\/blockquote>\n\n\n\n

What\u2019s the reason?
<\/strong>The Minister of Public Safety said the reason for the change<\/a> is to \u201cenable law enforcement and agencies to enforce, in a much stricter way, penalties for any form of illicit fundraising that takes place.\u201d<\/p>\n\n\n\n

What\u2019s the solution?
<\/strong>Not much else has been said about this proposed change. One simple way to address this potential change (should it come to pass) is having the donor give by cheque, e-transfer(s) or wire transfer instead of cash.<\/p>\n\n\n\n

What is CCCC doing?
<\/strong>Even so, we\u2019re writing to the relevant ministers to ask for more details. We understand the need to ensure the integrity of the charitable sector and eliminate illicit fundraising. But we also think it\u2019s important to understand why existing compliance tools are inadequate and to consider any unintended consequences or problematic precedents that could be set using this kind of approach.<\/p>\n\n\n\n
