{"id":36322,"date":"2023-04-12T13:57:51","date_gmt":"2023-04-12T17:57:51","guid":{"rendered":"https:\/\/www.cccc.org\/news_blogs\/?p=36322"},"modified":"2023-04-12T13:57:54","modified_gmt":"2023-04-12T17:57:54","slug":"parliamentary-committee-recommends-maid-expansion-expert-witnesses-respond-with-concern-criticism","status":"publish","type":"post","link":"https:\/\/cccc.org\/news_blogs\/legal\/2023\/04\/12\/parliamentary-committee-recommends-maid-expansion-expert-witnesses-respond-with-concern-criticism\/","title":{"rendered":"Parliamentary Committee Recommends MAID Expansion; Expert Witnesses Respond with Concern &#038; Criticism"},"content":{"rendered":"\n<p>In February, the Special Joint Committee on Medical Assistance in Dying (AMAD) issued its final report, <a href=\"https:\/\/www.parl.ca\/DocumentViewer\/en\/44-1\/AMAD\/report-2\" target=\"_blank\" rel=\"noreferrer noopener\">Medical Assistance in Dying in Canada: Choices for Canadians<\/a>. The report recommends significant and unprecedented expansion of medical assistance in dying (euthanasia and assisted suicide; \u201cMAID\u201d), including for children, by advance directive, and in support of MAID for incarcerated persons.<\/p>\n\n\n\n<p>As <a href=\"https:\/\/www.theglobeandmail.com\/canada\/article-maid-report-parliamentary-committee\/\" target=\"_blank\" rel=\"noreferrer noopener\">others have noted<\/a>, if the Committee\u2019s recommendations are followed, it would make Canada\u2019s euthanasia laws \u201camong the broadest in the world.\u201d<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 &#8230;it would make Canada\u2019s euthanasia laws \u201camong the broadest in the world\u201d<\/p>\n<\/blockquote>\n\n\n\n<p>Shortly after, a group of <a href=\"https:\/\/static1.squarespace.com\/static\/61db373a8e4e00423c117825\/t\/640739a3f6062c0b00236bbe\/1678195107898\/MAID+Report+Response+March+7+2023.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">43 Expert Witnesses (Experts) issued a response to<\/a> AMAD\u2019s recommendations in a letter that can only be described as a scathing critique. The letter, entitled \u201cExpert Witnesses Speak Out Against Bias in Medical Assistance in Dying Report\u201d does not mince words. It rejects the Committee report on the basis that it \u201cmisconstrues, misrepresents, minimizes and completely ignores key evidence necessary to protect Canadians.\u201d<\/p>\n\n\n\n<p>Before we briefly canvas AMAD\u2019s recommendations and the experts\u2019 letter in response, here are a few reasons why these developments matter.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why Does MAID Expansion Matter?<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Awareness<\/h3>\n\n\n\n<p>First, as with many legal developments, Christian <strong><em>ministries need to be aware of proposed legislation <\/em><\/strong>that will impact the way they provide care, outreach and activities. For example, many of you, our members, serve the elderly, the incarcerated, those with mental illness, children and youth, people with disabilities, and those with illness and disease. It is important to understand the legislative changes that will have a life and death impact on the communities and individuals you serve.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Viewpoint<\/h3>\n\n\n\n<p>Second, and more specifically, if your organization has a <strong><em>particular religious or conscientious view<\/em><\/strong> on MAID that would, for example, impact membership or board composition (a matter discussed in <a href=\"https:\/\/www.cccc.org\/kbm\/Content\/law\/cls\/archive\/horizons-2021-01-february-charter-rights-corporations-1387872560.htm\" target=\"_blank\" rel=\"noreferrer noopener\">past CCCC publications<\/a>), it is important that those views be appropriately reflected in various documents. Depending on the nature of your organization those documents could include bylaws, policies and procedures, statements of faith, or otherwise.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Engagement<\/h3>\n\n\n\n<p>Third, depending on your charity\u2019s purpose(s), you may want to <a href=\"https:\/\/www.canada.ca\/en\/revenue-agency\/services\/charities-giving\/charities\/policies-guidance\/public-policy-dialogue-development-activities.html#toc4\" target=\"_blank\" rel=\"noreferrer noopener\"><strong><em>engage with the public<\/em><\/strong> and\/or government on these issues<\/a>. For example, your charity might be well positioned to provide information related to your charitable purpose to inform or persuade the public about policy, to advocate to oppose or change law or policies, make representations to government, or convene forums for discussion.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Needs<\/h3>\n\n\n\n<p>Fourth, it reinforces the <strong><em>urgent need for the care and support <\/em><\/strong>that charities like you, our members, provide. As <a href=\"https:\/\/static1.squarespace.com\/static\/57503f9022482e2aa29ab3af\/t\/62796875c67afb653d0db906\/1652123765948\/CLF+brief+to+Special+Joint+Committee+on+Medical+Assistance+in+Dying+2022.05.09.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">others have set out in detail<\/a> and courts have noted, \u201cpsychological suffering (either alone or in combination with physical suffering) ha[s] contributed to 94% of MAID cases in Quebec.\u201d News reports tell heartbreaking stories of people applying for MAID due to <a href=\"https:\/\/ottawa.citynews.ca\/local-news\/ontario-man-applying-for-medically-assisted-death-as-alternative-to-being-homeless-5953116\/\" target=\"_blank\" rel=\"noreferrer noopener\">fears of homelessness<\/a>, <a href=\"https:\/\/toronto.ctvnews.ca\/toronto-woman-in-final-stages-of-maid-application-after-nearly-a-decade-long-search-for-housing-1.6145487\" target=\"_blank\" rel=\"noreferrer noopener\">lack of accessible housing<\/a>, <a href=\"https:\/\/www.cbc.ca\/radio\/thecurrent\/maid-poverty-disability-1.6687453\" target=\"_blank\" rel=\"noreferrer noopener\">poverty and disability<\/a>, and MAID being offered to <a href=\"https:\/\/www.ourcommons.ca\/DocumentViewer\/en\/44-1\/ACVA\/meeting-27\/evidence\" target=\"_blank\" rel=\"noreferrer noopener\">veterans suffering with post-traumatic stress disorder<\/a>. Whether your charity alleviates poverty, advances religion or has other purposes, support and care for those with disabilities, mental illness, those in poverty or homelessness, your work is needed. The support your charity provides can reduce social isolation, love and care for vulnerable, give hope, and nurture both psychological and spiritual well-being.<\/p>\n\n\n\n<p>In sum, these proposed changes will have a significant and permanent impact on the social, charitable, cultural, medical, ethical and legal landscape in Canada. Let\u2019s take a quick look at some of AMAD\u2019s recommendations and the experts\u2019 response letter.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Special Joint Committee on Medical Assistance in Dying<\/h2>\n\n\n\n<p>The Committee was established in April 2021 to review the state of palliative care in Canada and to review MAID and mental illness, mature minors, advance requests, and the protection of Canadians with disabilities, as required by <a href=\"https:\/\/www.parl.ca\/DocumentViewer\/en\/42-1\/bill\/C-14\/royal-assent\" target=\"_blank\" rel=\"noreferrer noopener\">Bill C-14<\/a> and <a href=\"https:\/\/www.parl.ca\/legisinfo\/en\/bill\/43-2\/c-7\" target=\"_blank\" rel=\"noreferrer noopener\">Bill C-7<\/a>, respectively.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Committee\u2019s Report &amp; Recommendations<\/h2>\n\n\n\n<p>The Committee\u2019s Report 138-page report has 23 recommendations and was presented to Parliament on February 15, 2023. The Report also includes an important dissenting opinion (see page 105).<\/p>\n\n\n\n<p>The recommendations include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Affirming MAID expansion for mental illness<\/li>\n\n\n\n<li>Directing additional study of proposed safeguards for MAID for mental illness<\/li>\n\n\n\n<li>Allowing advance requests for MAID<\/li>\n\n\n\n<li>Expand MAID to children and youth (\u201cmature minors\u201d)<\/li>\n\n\n\n<li>Limit parental involvement \u2013 \u201cwhere appropriate\u201d consult parents, but the will of the child prevails<\/li>\n\n\n\n<li>Study MAID for \u201cmature minors\u201d 5 years after it is legal<\/li>\n\n\n\n<li>Consult with minors about MAID<\/li>\n\n\n\n<li>Consider increasing funding for implementing the Action Plan on Palliative Care<\/li>\n\n\n\n<li>Support MAID for inmates<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">The Experts\u2019 Response to the Committee<\/h2>\n\n\n\n<p>Here are some of the 43 Experts\u2019 concerns and responses related to each issue reviewed by the Committee:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">MAID for mental illness as the sole underlying medical condition<\/h3>\n\n\n\n<p>The Experts find AMAD\u2019s recommendations \u201c\u2026deeply flawed and selectively ignore evidence while preferentially accepted personal opinions of witnesses ideologically favouring expansion.\u201d<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">MAID expansion to youth and children<\/h3>\n\n\n\n<p>On this topic, the Experts concluded that \u201c[t]he committee failed to act as mature adults who recognize that minors are a group with unique disadvantages arising inherent within human development, and thereby are dependent upon adult legislators to create laws that effectively protect minors from systemic abuses.\u201d And further, that AMAD<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u201c\u2026failed to draw attention to the fact that there is a paucity of evidence that assessment [for a minor\u2019s decision-making capacity] are sufficiently rigorous or reliable\u201d and<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u201c\u2026 paid lip service to the importance of safeguards, failing to provide any robust safeguards and undermining natural safeguards in the life of minors.\u201d<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Regarding the state of palliative care<\/h3>\n\n\n\n<p>The Experts felt that AMAD dismissed evidence from nationally and internationally recognized palliative care experts about why palliative care and MAID should remain separate and distinct, including that \u201cpalliative care holds as both a clinical and legal safeguard for MAID\u2026\u201d;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Regarding protections for Canadians with disabilities<\/h3>\n\n\n\n<p>While the letter outlines many critiques, two key critiques of AMAD\u2019s recommendations were that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u201cThe Report [\u2026] ignored, diminished and misrepresented the statements of disabled witnesses who were allotted 5 minutes to contextualize and explain MAID\u2019s place in Canada\u2019s history of eugenics and oppression of disabled people\u201d;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u201cDisabled people are the only people eligible for MAID. \u2026 All the language used in MAID legislation is a synonym for disability.\u201d The experts \u201coppose in the strongest possible terms removing the word disability from legislation that specifically targets disabled lives. That is deception not destigmatization.\u201d<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Regarding MAID in prisons<\/h3>\n\n\n\n<p>The Experts found MAID in prisons particularly disconcerting: \u201cOffering people an opportunity to leave prison \u2013 where they can spend time with their families \u2013 on condition that they sign up for MAID is enticement, especially where parole by exception is often not accessible.\u201d<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Regarding advance requests for MAID<\/h3>\n\n\n\n<p>Lastly, in regard to advance requests, the Experts letter concludes that AMAD<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>failed to provide \u201csolid evidence that prior consent remains valid\u201d;<\/li>\n\n\n\n<li>did not hear sufficient evidence from \u201cclinicians with expertise in caring for the elderly\u201d as they \u201cunderrepresented\u201d among the Committee witnesses;<\/li>\n\n\n\n<li>made a recommendation that \u201cruns counter to the emphasis on \u2018clear consent\u2019\u201d in the <em>Carter <\/em>decision;<\/li>\n\n\n\n<li>\u201c\u2026recommendations on MAID by advance request reflect the activism of witnesses and politicians, not the prudence and knowledge necessary in considering such a life and death matter.\u201d<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">What\u2019s Next?<\/h2>\n\n\n\n<p>As per usual, we can expect the government to issue a response to this, AMAD\u2019s second report. <a href=\"https:\/\/parl.ca\/DocumentViewer\/en\/44-1\/AMAD\/report-1\/\" target=\"_blank\" rel=\"noreferrer noopener\">AMAD\u2019s first report<\/a> was presented to Parliament in June, 2022 and the <a href=\"https:\/\/parl.ca\/DocumentViewer\/en\/44-1\/AMAD\/report-1\/response-8512-441-119\" target=\"_blank\" rel=\"noreferrer noopener\">government\u2019s response<\/a> was presented in October, 2022.
