Aga et al.&nbsp; The case involves an internal church dispute that found its way into the civil courts. In 2018, the SCC in the <em><a href=\"https:\/\/scc-csc.lexum.com\/scc-csc\/scc-csc\/en\/item\/17101\/index.do\">Wall<\/a> <\/em>decision ruled that voluntary religious communities are free to determine membership in accordance with their own culture, beliefs and practices.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" width=\"625\" height=\"417\" src=\"https:\/\/i0.wp.com\/www.cccc.org\/news_blogs\/wp-content\/uploads\/2018\/05\/IMG_5851-1024x683.jpg?resize=625%2C417&#038;ssl=1\" alt=\"\" class=\"wp-image-27640\" srcset=\"https:\/\/i0.wp.com\/cccc.org\/news_blogs\/wp-content\/uploads\/2018\/05\/IMG_5851.jpg?resize=1024%2C683&amp;ssl=1 1024w, https:\/\/i0.wp.com\/cccc.org\/news_blogs\/wp-content\/uploads\/2018\/05\/IMG_5851.jpg?resize=300%2C200&amp;ssl=1 300w, https:\/\/i0.wp.com\/cccc.org\/news_blogs\/wp-content\/uploads\/2018\/05\/IMG_5851.jpg?resize=768%2C512&amp;ssl=1 768w, https:\/\/i0.wp.com\/cccc.org\/news_blogs\/wp-content\/uploads\/2018\/05\/IMG_5851.jpg?w=1250&amp;ssl=1 1250w, https:\/\/i0.wp.com\/cccc.org\/news_blogs\/wp-content\/uploads\/2018\/05\/IMG_5851.jpg?w=1875&amp;ssl=1 1875w\" sizes=\"auto, (max-width: 625px) 100vw, 625px\" \/><\/figure>\n\n\n\n<p>However, in the <em>Aga<\/em> case, the <a href=\"http:\/\/canlii.ca\/t\/j4g09\">Ontario Court of Appeal<\/a> created confusion by deciding that courts can review decisions on membership of religious organizations. The ONCA went so far as to say that mere membership in a church is a legally enforceable contract: a church\u2019s constitution and by-laws automatically \u201cconstitute a contract setting out the rights and obligations of members and the organization\u201d, regardless of whether the member has \u201cspecific knowledge of or expressly consents to the specific terms in the by-laws\u201d (paras. 40, 43).<\/p>\n\n\n\n<p>That decision directly conflicts with the <em>Wall<\/em> decision.&nbsp;<\/p>\n\n\n\n<p>But there is more. The ONCA also created confusion when it said that donations to a church were evidence of \u201cconsideration\u201d.<a href=\"#_ftn1\">[1]<\/a> The legal term \u201cconsideration\u201d refers to the exchange within a contractual relationship. For example, imagine that you buy a car for $5,000.00. The $5,000.00 you give to the vendor is \u201cconsideration\u201d in return for which you get the vehicle. The car is also \u201cconsideration,\u201d which must flow both ways. Another term often used is <em>quid pro quo,<\/em> Latin for \u201csomething for something.\u201d&nbsp;<\/p>\n\n\n\n<p>Now consider: if one\u2019s tithe to a church were \u201cconsideration\u201d, that would mean the offerings were no longer voluntary gifts, but the fulfillment of a contract, paid with the expectation of \u201csomething\u201d in return. What possibly could that \u201csomething\u201d be? What does the church owe the member? It would appear that the ONCA is saying, \u201cWell that \u2018something\u2019 is found in the \u2018contract\u2019 which is the constitution and by-laws of the church.\u201d&nbsp;<\/p>\n\n\n\n<p>Unfortunately, the ONCA has it wrong.&nbsp;<\/p>\n\n\n\n<p>First, it would be news to the Canada Revenue Agency that donations given to the church are \u201cconsideration.\u201d Under such a scenario, gifts to a church are no longer voluntary but obligatory to meet the terms of the \u201ccontract\u201d. That would mean that donations are not donations and, therefore, no charitable tax deduction receipts should be issued.&nbsp;<\/p>\n\n\n\n<p>Second, church membership is entirely voluntary. There is no consideration. There are no property rights. There are no civil rights. That means a church may accept or reject any person, based on its own, self-determined rules. Religious groups are composed of people who share certain beliefs and practices. Members of a church may see themselves as part of a spiritual family with a God-given responsibility to care for one another (e.g. Galatians 6:2), but this is not a &nbsp;contractual relationship in the legal sense. Thus, secular courts have no legitimate business to get involved in these relationships.<\/p>\n\n\n\n<p>The SCC\u2019s decision to hear the <em>Aga <\/em>case is a huge development, in part because the ONCA decision was unanimous 3-0. It is rare that the SCC will hear a civil appeal from an appellate court that was so one-sided. However, it is obvious that the SCC recognizes the dramatic challenge the ONCA decision poses to its <em>Wall <\/em>decision.&nbsp;<\/p>\n\n\n\n<p>I hold that the SCC\u2019s review of the ONCA is a positive development for the right of religious communities to be free from state interference in internal matters. It is an issue we thought was settled in 2018, but we now must argue it again one more time.<\/p>\n\n\n\n<p>CCCC\u2019s will intervene in this appeal to remind the SCC how important this issue is to our members.
