{"id":28967,"date":"2020-04-13T15:00:53","date_gmt":"2020-04-13T19:00:53","guid":{"rendered":"https:\/\/www.cccc.org\/news_blogs\/?p=28967"},"modified":"2020-05-22T10:51:31","modified_gmt":"2020-05-22T14:51:31","slug":"covid-19-alberta-suspends-in-person-meetings-under-societies-act","status":"publish","type":"post","link":"https:\/\/cccc.org\/news_blogs\/legal\/2020\/04\/covid-19-alberta-suspends-in-person-meetings-under-societies-act\/","title":{"rendered":"COVID-19: Alberta Suspends In-Person Meetings under Societies Act"},"content":{"rendered":"<div class=\"pps-series-post-details pps-series-post-details-variant-classic pps-series-post-details-38706\" data-series-id=\"440\"><div class=\"pps-series-meta-content\"><div class=\"pps-series-meta-text\">This entry is part 17 of 45 in the series <a href=\"https:\/\/cccc.org\/news_blogs\/series\/covid-19\/\">COVID-19<\/a><\/div><\/div><\/div>\n<figure class=\"wp-block-image size-large\"><a href=\"https:\/\/thegreen.community\/c\/cccc-covid19-response\/\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"396\" src=\"https:\/\/www.cccc.org\/news_blogs\/wp-content\/uploads\/2020\/04\/CoronaVirus-Masthead2-1600-1024x396.jpg\" alt=\"\" class=\"wp-image-28934\"\/><\/a><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">On April 9, 2020 Alberta issued a <a href=\"https:\/\/open.alberta.ca\/publications\/ministerial-order-no-sa-009-2020-service-alberta\">Ministerial Order<\/a> that provides the following administrative relief for organizations incorporated under the <em>Societies Act<\/em>:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Obligations to hold in-person meetings are suspended (s 25 <em><a href=\"http:\/\/canlii.ca\/t\/53j53\">Societies Act<\/a><\/em>) but nothing in the suspension precludes a society from holding a remote meeting using video or teleconferencing<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Obligation to send or make a report, annual return or return to the Registrar is suspended (s 26(2) <em><a href=\"http:\/\/canlii.ca\/t\/53j53\">Societies Act<\/a><\/em>)<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Charitable registrations or renewals that would expire while the emergency order is in effect have an additional <strong>3 months<\/strong> before the expiry is effective (new s 9(5.1 ) <a href=\"http:\/\/canlii.ca\/t\/52xs2\">Charitable Fund-Raising Regulation<\/a>)<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>A similar <strong>3 month<\/strong> extension has been added for fund-raising businesses (new s 10(4.1) <a href=\"http:\/\/canlii.ca\/t\/52xs2\">Charitable Fund-Raising Regulation<\/a>)<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Provisions relating to in-person access to regular places of business for the inspection of physical documents and records are suspended (s 36(2) <em><a href=\"http:\/\/canlii.ca\/t\/53j53\">Societies Act<\/a><\/em>)<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Trustees who have received monetary contributions for a charity now have <strong>15 days <\/strong>instead of 3 days to properly deposit the money (s 11(2) <em><a href=\"http:\/\/canlii.ca\/t\/536rz\">Charitable Fund-Raising Act<\/a><\/em>)<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Starting <strong>April 15<\/strong>, Alberta has <a href=\"https:\/\/www.alberta.ca\/release.cfm?xID=7007558C88EA2-0676-88A4-A16942AEB2DF250E\">pledged to match<\/a>, dollar for dollar up to $2 million to Alberta-based charities and non-profit organizations with COVID-19 fundraising campaigns.
