The report is 190\npages long and contains 42 recommendations and over 500 footnotes. So, what do\nyou need to know? Over the course of the next week, we\u2019ll break down the\nrecommendations and content of the report into categories, highlighting the\nmost interesting and relevant portions. Today we\u2019ll look at some of the \u2018big\npicture\u2019 considerations, beginning with context. <\/p>\n\n\n\n<p>Context,\nthey say, is king. And the context of this report is certainly important.\nFirst, the report contains <em>non-binding <\/em>recommendations.\nSecond, the report was released near the end of the Parliamentary session in an\nelection year. Third, the report tasks government agencies, departments, and\nbodies \u2013 some of which do not yet exist \u2013 with examining and evaluating issues\nthat the CSSB has simply noted or recognized in the report. <\/p>\n\n\n\n<p>All of this\nmeans that there is a great deal of uncertainty about the report, particularly\nwhether and to what extent it will tangibly impact the charitable sector. <\/p>\n\n\n\n<p>For example,\nthe report in Recommendation 25 tasks the new <a href=\"https:\/\/www.canada.ca\/en\/revenue-agency\/programs\/about-canada-revenue-agency-cra\/corporate-reports-information\/advisory-committee-charitable-sector.html\">Advisory Committee on the\nCharitable Sector<\/a> (\u201cACCS\u201d) with reviewing the common\nlaw meaning of charity. Undertaking an evaluation of the very meaning of\ncharity, and whether its definition should remain in the common law or should\nbe legislatively defined is, on its own, a massive question with significant\nimplications for the sector. <\/p>\n\n\n\n<p>Further, the\nACCS is going to be made up of 12 senior-level representatives from across\nsectors, but as of yet only the co-chairs have been appointed. It is to include\n\u201cregistered charities, national umbrella organizations, professional\nassociations, charity researchers\/academics, and legal experts.\u201d The Report, in\nRecommendation 21, adds that the ACCS should also include \u201csmaller\norganizations, organizations in rural and remote communities, organizations\nrepresenting and serving newcomers to Canada and organizations supporting and\nserving Indigenous communities.\u201d Will this prompt the Minister of National\nRevenue or the Commissioner of the CRA to revisit pending appointments? Will\nthis guide appointments not yet made? We\u2019re left to speculate.<\/p>\n\n\n\n<p>As we noted\nat the outset, the speculation inherent in elections also plays a key part in\nunderstanding the Report. It may be that the Federal Government of Fall 2019 is\nelected with a totally different mandate than the present government,\nregardless of which party forms a majority. It could be that a new mandate is\nprioritized by departments and agencies over and above this report. Or, this report\nand its recommendations may be central to their priorities. Again, we\u2019re left\nto speculate. <\/p>\n\n\n\n<p>Since these recommendations\nare not binding, there may be little reason for the government to make the report\na priority and it could simply be shelved. All of this means \u2013 you guessed it \u2013\nwe\u2019re left to speculate as to the ultimate impact of the report\u2019s contents. <\/p>\n\n\n\n<p>Depending on\nif and how the recommendations are understood, applied and advanced, they could\nhave a significant or subtle impact on the charitable sector.
