Milley, Associate Director, Legal Affairs<\/p>\n<p><strong>On July 27, 2016 the\u00a0Canadian Radio-television and Telecommunications Commission (&#8220;CRTC&#8221;)\u00a0released an Enforcement Advisory directed to businesses and individuals in Canada that send commercial electronic messages (\u201cCEMs\u201d).<a href=\"#_edn1\" name=\"_ednref1\">[i]<\/a> \u00a0This advisory is a reminder to\u00a0senders of CEMs that they must comply with the\u00a0record keeping requirements under CASL and ensure they maintain evidence of consent.<\/strong><\/p>\n<p>The CRTC advisory\u00a0notes that some businesses and individuals are unable to prove they have obtained consent before they send CEMs.\u00a0The onus of proving consent, whether express or implied, remains with the person sending, causing or permitting the sending of CEMs.<a href=\"#_edn2\" name=\"_ednref2\">[ii]<\/a> This is the case even if the sender is relying on an existing business or non-business relationship that was created prior and post July 1, 2014.<a href=\"#_edn3\" name=\"_ednref3\">[iii]<\/a><\/p>\n<p>The CRTC advisory recommends\u00a0that senders of CEMs\u00a0should consider keeping a hard copy or an electronic record of, among others:<\/p>\n<ul>\n<li>all evidence of express and implied consent (e.g. audio recordings, copies of signed consent forms, completed electronic forms) from consumers who agree to receive CEMs<\/li>\n<li>documented methods through which consent was collected<\/li>\n<li>policies and procedures regarding CASL compliance<\/li>\n<li>all unsubscribe requests and resulting actions<\/li>\n<\/ul>\n<p>For more information on CASL compliance and record keeping, please refer to\u00a0the following resources:<\/p>\n<ul>\n<li>CCCC\u2019s\u00a0<a href=\"https:\/\/www.cccc.org\/bulletin_article\/392\">how to guide for charities on complying with CASL<\/a>;<\/li>\n<li>CCCC\u2019s\u00a0<a href=\"https:\/\/www.cccc.org\/cart\/view_item\/anti_spam_law_recorded\">webinar on CASL<\/a>;<\/li>\n<li>CRTC\u2019s\u00a0<a href=\"http:\/\/www.crtc.gc.ca\/eng\/archive\/2014\/2014-326.htm\">guidance on corporate compliance programs;<\/a>\u00a0and<\/li>\n<li>CRTC\u2019s\u00a0<a href=\"http:\/\/www.crtc.gc.ca\/eng\/com500\/guide.htm\">guidance onconsent and how to prove consent<\/a>.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><a href=\"#_ednref1\" name=\"_edn1\">[i]<\/a> See:\u00a0<a href=\"http:\/\/news.gc.ca\/web\/article-en.do?nid=1104989\">http:\/\/news.gc.ca\/web\/article-en.do?nid=1104989<\/a>.<\/p>\n<p><a href=\"#_ednref2\" name=\"_edn2\">[ii]<\/a> An Act to Promote the Efficiency and Adaptability of the Canadian Economy by Regulating Certain Activities that Discourage Reliance on Electronic Means of Carrying out Commercial Activities, and to Amend the Canadian Radio-television and Telecommunications Commission Act, the Competition Act, the Personal Information Protection and Electronic Documents Act and the Telecommunications Act, SC 2010, c 23, s. 13.<\/p>\n<p><a href=\"#_ednref3\" name=\"_edn3\">[iii]<\/a> See:\u00a0<a href=\"http:\/\/news.gc.ca\/web\/article-en.do?nid=1104989\">http:\/\/news.gc.ca\/web\/article-en.do?nid=1104989<\/a>.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>  \u00a0By Philip A.S.
