Recently CCCC received a number of emails containing\u00a0such a request.<\/p>\n<p>Requests such as these are not uncommon. Sometimes they come from complete strangers, but in other cases, they may originate from organizations that are familiar to you and even share your charity\u2019s values and goals.<\/p>\n<p>No matter where the request comes from, charities should be aware of their obligations under the law, including <a href=\"https:\/\/www.priv.gc.ca\/leg_c\/r_o_p_e.asp\"><em>PIPEDA<\/em><\/a>, Canada\u2019s federal privacy legislation.<a href=\"#_edn1\" name=\"_ednref1\">[1]<\/a> Although many of a charity`s\u00a0activities, such as collecting membership fees, compiling a list of members\u2019 names, and fundraising are considered not to be strictly subject to PIPEDA<a href=\"#_edn2\" name=\"_ednref2\">[2]<\/a><em>, <\/em>the legislation does specifically apply to the \u201cselling, bartering or leasing of donor, membership or other fundraising lists\u201d.<a href=\"#_edn3\" name=\"_ednref3\">[3]<\/a> As a result, charities must obtain consent from a donor before \u201cselling, bartering, or leasing\u201d their information to another organization (which we fully expect would include an exchange for consideration, such as access to another charity\u2019s list of donors).<\/p>\n<p>Further, <a href=\"http:\/\/fightspam.gc.ca\/eic\/site\/030.nsf\/eng\/home\">Canada\u2019s anti-spam legislation (\u201c<em>CASL\u201d<\/em>)<\/a> prohibits organizations, including charities, from sending commercial electronic messages without the recipient\u2019s express or implied consent (unless an exemption applies).<a href=\"#_edn4\" name=\"_ednref4\">[4]<\/a> Charities therefore may\u00a0not be permitted to send certain messages to contacts from another organizations\u2019 donor list, unless the sending charity has itself obtained consent from each recipient, or an exemption applies.<\/p>\n<p>In addition, many (if not all) fundraising codes of ethics provide that charities will not exchange, rent, or share their donors\u2019 information with other organizations.<\/p>\n<p>Legal obligations aside, charities should consider how their donors might feel if their personal information were disclosed without their consent. Some might have a sense of betrayal or anger; others might feel taken advantage of. Any gain your charity might experience as a result of a new list of prospective donors could be outweighed by the damage to your existing donor base (and many of the \u201cnew\u201d donors you will be contacting could be just as unhappy).<\/p>\n<p>While charities should always be willing to work with other organizations and share ideas, experiences, and best practices, they should never disclose donor information without their consent.<\/p>\n<p>Should charities ever share donor lists, even with consent? Ultimately, each charity will have to decide for itself how it wants to approach this issue. For those charities that wish to share donor lists with other organizations, they should at minimum (i) clearly communicate to their donors what their policy is on information-sharing; (ii) ensure they have their donors\u2019 express consent before sharing any of their personal information; and (iii) verify that the other organization also has their donors\u2019 consent to share their information as well. In addition, charities will need to ensure their communications with any new contacts are in compliance with <em>CASL<\/em>.<\/p>\n<p>However, it should be noted that most individuals will be less inclined to donate to organizations that trade or barter their personal information. For this reason, many charities have implemented policies and adhere to fundraising codes that prohibit the sharing of donor lists. CCCC has a sample <a href=\"https:\/\/www.cccc.org\/members_sample_documents_view\/html\/11\">Ethical Fundraising and Financial Accountability Code<\/a> and sample <a href=\"https:\/\/www.cccc.org\/sample_documents\">Privacy Policies<\/a> for charities to consider adopting (member password required).<\/p>\n<p><span style=\"text-decoration: underline;\"><i>References<\/i><\/span><\/p>\n<p><a href=\"#_ednref1\" name=\"_edn1\">[1]<\/a> <em>Personal Information Protection and Electronic Documents Act<\/em>, S.C. 2000, c. 5. [\u201cPIPEDA\u201d].<\/p>\n<p><a href=\"#_ednref2\" name=\"_edn2\">[2]<\/a> See Office of the Privacy Commissioner of Canada, Fact Sheet: \u201c<a href=\"https:\/\/www.priv.gc.ca\/en\/privacy-topics\/privacy-laws-in-canada\/the-personal-information-protection-and-electronic-documents-act-pipeda\/02_05_d_19\/\">The Application of the Personal Information Protection and Electronic Documents Act to Charitable and Non-Profit Organizations<\/a>\u201d (modified April 1, 2004).<\/p>\n<p><a href=\"#_ednref3\" name=\"_edn3\">[3]<\/a> PIPEDA, s. 2(1) (definition of \u201ccommercial activity). Although PIPEDA does not apply in provinces which have adopted their own \u201csubstantially similar\u201d privacy legislation (as in <a href=\"http:\/\/servicealberta.ca\/pipa\/\">Alberta<\/a>, <a href=\"http:\/\/www.bclaws.ca\/Recon\/document\/ID\/freeside\/00_03063_01\">British Columbia<\/a>, and <a href=\"http:\/\/www2.publicationsduquebec.gouv.qc.ca\/dynamicSearch\/telecharge.php?type=2&#038;file=\/P_39_1\/P39_1_A.html\">Quebec<\/a>), those provinces also have certain consent requirements.<\/p>\n<p><a href=\"#_ednref4\" name=\"_edn4\">[4]<\/a> See <a href=\"http:\/\/laws-lois.justice.gc.ca\/eng\/acts\/E-1.6\/page-2.html#h-5\">s. 6 of the legislation<\/a> as well as the CRTC\u2019s FAQs on CASL.
